Does RIA Really Evaluate Regulatory Impact? The Case of the Czech Republic

Regulatory Impact Assessment/Analysis (RIA) has become a hot topic in the world politics as well as economic research in the last 20 years. Its basic definition as a tool to improve regulatory quality using cost-benefit analysis is viable only in the case when it is properly implemented for all potential sources of regulation, one of which is parliament with its amendments to bills. After summing up basic information about RIA and its history and surveying relevant literature on RIA, this thesis performs a pioneer analysis of the changes in regulatory impact of laws caused by parliamentary amendments. A sample of all laws passed in the Czech Republic in 2010 is studied. The passed amendments to these laws are analysed and it is found that only 3 out of 20 bills with RIA had amendments which made no changes in regulatory impacts of the bill. This supports the conclusion that the RIA implementation should take these amendments into account. Another finding is that circumventing of the RIA system occurs also in the case of non-governmental bills, which are not subject to RIA in the Czech Republic, as 18 of 32 bills without RIA did not have it due to their non-governmental origin.

Analyses accompanying creation of law on the example of regulation of new phenomena, the so-called shared economy Abstrakt v anglickém jazyce This thesis deals with analyzes preceeding the parliamentary phase of the legislative process on the example of the modern phenomenon, the shared economy. In the case of regulation of a shared economy, the legislator faces a difficult task of regulating yet unregulated, and in such cases, there is a risk that in the event of an incorrect analysis, the regulation may be unfunctional and thus unnecessary. The author chose two analyzes for his thesis, namely analysis of regulatory impact assessment and related explanatory report. The topic becomes more important when we consider that today's era is called the age of legislation. In some ways, it also offers an alternative view of improving the quality of regulation (usually laws), because although the legislator is trying in every way to improve the quality of the Czech legal system, it focuses entirely on the legislative process in the chambers of the Parliament, or adopts new adjustments for the greater transparency of the legislative process. The Analysis of Impact of Regulations: A Dynamic Input-Output Model Approach

This diploma thesis discusses utilization of dynamic Input-Output models as a basis for decision-making for policy makers. The first part is focused on theoretical derivation of the basic dynamic models. This part is followed by a practical application of the presented models, which proposes a method of deriving the matrix of capital and it facilitates the construction of data sources. The results show that the dynamic models are usable, but it is necessary to take into consideration their structural constraints and data limits. Data applied for 2009 show that the economic crisis has led to a 6% decline in GVA growth rates.
Analysis of regulatory impact assesment on specific environmental legislative act proposal

This thesis is comparing impacts defined by Regulatory impact assessment (RIA) with real impacts discovered with online survey related to the specific Czech environmental legislative act. There is described RIA, experience with RIA in Czech and comparison of development and experience of RIA in EU and USA. As a result, comparison of the impacts within RIA and the ones identified by the survey is that real impacts are different from the predicted ones within RIA. The summary of this thesis is that process RIA is alright but accuracy of predicted impacts is dependent on RIA processor, rigorousness and complexity of RIA.
Comparative analysis of approaches to regulatory impact assessment (RIA) with an emphasis on the regulation proportionality concept

The process of Regulatory Impact Assessment (RIA) is a globally widespread tool to avoid excessive regulation. One of its basic principles is the proportionality of regulation. It is a modern concept, which is not in the literature devoted too much attention. The proportionality of regulation is mainly based on three requirements. Control should be adequate to the problem addressed, it should not lead to excessive regulation and the net social impact should be positive. Based on comparative analysis of two specific (Czech and British) RIAs, the application of the principle of proportionality is not sufficient in practice. Most adequacy requirements are not met or the process is not satisfactorily evaluated by RIA. Depth evaluation of the impacts in both RIAs is very different. The main recommendation arising from the whole paper is the need to evaluate not only economic but also social and environmental impacts.
Use of Input-Output analysis on the microeconomic level

This bachelor thesis considers possibility of using IO analysis for modelling of regulatory impact. First it is focused on explanation of deriving IO models. Then the way of integrating regulation into IO theory paradigm is suggested and it is used in case study of Teplárna Strakonice a.s.( Heating plant Strakonice) which ilustrates the problem of regulation with planned price increase of emission charge and coal. Results show that modified IO model with regulatory matrix applied on this particular company predicts lower impact of price increasing than other commonly used regulatory models.
Institutional analysis and critical assessment of the effectiveness of newly proposed changes to Regulatory Impact Assessment RIA

The main goal of this work is analysis of Regulatory Impact Assessment RIA, which was implemented into the Czech Republic's legislature on 1 November, 2007. The presented bachelor thesis builds upon theoretical basis and from definitions of relations between competitiveness, business environment and regulations proceeds to Regulatory Impact Assessment. A brief history of the aforementioned instrument is included, as well as is a summary of problems which have been stated in RIA evaluation reports regarding the topic. The presented thesis follows their course and to a large extent confirms the hypothesis stating the formality of approach towards Regulatory Impact Assessment and tendencies towards slapdash processing of the evaluation. Furthermore, the bachelor thesis brings up other interesting assumptions stemming from the provided analysis. To the work's close, recommendations to increasing regulation's efficiency are inferred.
Regulatory Impact Assessment in the Czech Republic -- Possibilities of Use

Implementace a institucionální zabezpečení projektu RIA v ČR

Práce se zabývá problematikou implementace a institucionálního zabezpečení projektu RIA (Regulatory Impact Assessment) v ČR. Organizační struktura oblasti hodnocení dopadů regulace musí být navržena tak, aby zajistila kvalitní hodnocení dopadů. Útvar zastřešující RIA musí být tedy při Úřadu vlády ČR. Hodnocení dopadů regulace provádí ad hoc pracovní skupiny, jejichž činnost zastřešuje útvar pro RIA při příslušném orgánu ústřední státní správy. Nedílnou součástí hodnocení dopadů jsou konzultace se zainteresovanými subjekty.
